The Spanish government offers attractive tax deductions to investors in film and television productions, but the criteria for eligibility are specific. To qualify for these fiscal benefits, you must be a producer registered in the ICAA’s Registry of Film and Audiovisual Companies and be responsible for executing the production. Mainland Spain and Balearic Islands Incentives

For most audiovisual productions filming on the Spanish mainland or the Balearic Islands (including Mallorca, Ibiza, and Menorca), the tax rebate stands at a highly competitive rate. International productions can benefit from a 30% deduction on the first million euros of the deduction base, and 25% on the remaining expenditure made in Spanish territory. This makes cities like Barcelona a fiscally responsible choice for commercial shooting and long-form content.

To qualify, total eligible expenses in Spain must reach at least €1 million, or €200,000 for animated productions. The tax base includes the total production cost, as well as copies, promotion, and advertising costs incurred by the producer (limited to 40% of the production cost). The maximum deduction limits are currently capped at €20 million per feature film and €10 million per episode for television series. Additionally, the total amount of combined incentives may not exceed 50% of the production cost.

Canary Islands and Navarre Regional Bonuses

Two specific regions offer enhanced incentives designed to attract foreign filmmakers.

  • Canary Islands: Productions can access up to a 50% deduction if a minimum spend of €1 million (€200,000 for animation) occurs in the region. The maximum deduction per project is capped at €18 million.
  • Navarre: Provides a 35% deduction (rising to 40% for animation and special works) provided that at least 40% of the deductible base is spent within the region. In Navarre, the maximum deduction is capped at €5 million, with no quota limit.

The Cultural Test, Nationality, and Mandatory Deposits

To qualify for a tax rebate, every production must prove its cultural value. According to Article 22 of Royal Decree 1084/2015, a Cultural Certificate must be obtained from the ICAA by meeting at least two specific criteria, such as the use of an official Spanish language, storylines relating to Spanish reality, or the promotion of social diversity.

Furthermore, a Nationality Certificate is required. This mandates that at least 75% of authors (including the director), cast, and technical teams are EU citizens or legal residents. Additionally, filming, post-production, and lab work must be performed in Spain or other EU countries.

Important Note: A final administrative requirement is the deposit of a new, perfect-condition copy of the completed work in the Spanish Film Archive (Filmoteca Española) or an officially recognized regional archive.

Intensity Limits and Combining Incentives

While the standard limit for combined public aid is 50%, this increases significantly under specific conditions to support diverse voices:

  • 85% for short films.
  • 80% for first-time or second-time directors with budgets under €1.5M.
  • 80% for works in co-official languages other than Spanish (such as Catalan, Basque, or Galician).
  • 75% for documentaries or productions directed exclusively by women.
  • 60% for international co-productions with Ibero-American countries.
